Terms and Conditions of Service
TruServ Plumbing LLC
1. Authorization of Work
By authorizing service, the customer (hereinafter “Client” or “Owner”) approves TruServ Plumbing LLC (“Company”) to perform the plumbing and/or heating services described and agrees to these Terms and Conditions.
2. Emergency Service
Emergency, after-hours, weekend, and holiday services are billed at emergency service rates. By requesting emergency service, the Client acknowledges and agrees to the applicable emergency charges.
3. Scope of Work
The work performed is limited to the services described on this invoice or service description. Any additional work required due to unforeseen conditions, code requirements, or concealed issues will be discussed with the Client and may result in additional charges.
4. Estimates and Pricing
All pricing is based on visible conditions at the time of service.
Plumbing and heating systems may contain hidden or pre-existing issues that cannot be detected during a standard inspection.
The Company is not responsible for additional repairs required due to such conditions.
5. Payment Terms
Payment is due in full upon completion of service unless otherwise agreed to in writing.
Accepted forms of payment include cash, check, and approved electronic payment methods.
Unpaid balances may be subject to late fees, service charges, and collection costs as permitted under Massachusetts law.
Any unpaid balances and/or invoices will be submitted by the Company to the Client monthly and will include any and all amounts due to the Company and will bear interest of 1.5% per month commencing 30 days from the date of the completion of service. The Company shall be entitled to reimbursement of any and all costs of collection, including reasonable legal fees, and any associated and/or required fees and costs, to enforce its rights hereunder.
6. Returns and Credits
All sales of labor, parts, and materials are final. No refunds or credits will be issued once work has been completed, except as required by law.
7. Warranties
The Company provides a limited workmanship warranty as stated on the invoice.
Manufacturer warranties apply to parts and equipment and are subject to the manufacturer’s terms.
Warranties do not cover damage caused by misuse, neglect, freezing, lack of maintenance, or work performed by others.
8. Limitation of Liability
The Company is not responsible for damages resulting from pre-existing conditions, system failure, hidden defects, or structural limitations. The Company’s liability is limited to the amount paid for the service provided.
9. Property Conditions and Damage
The Client acknowledges that plumbing and heating work may require cutting, drilling, or accessing concealed areas. While reasonable care will be taken, the Company is not responsible for damage to walls, floors, ceilings, landscaping, or other materials necessary to complete the work.
10. Safety and Access
The Client agrees to provide safe and clear access to the work area. The Company reserves the right to stop or refuse service if unsafe or hazardous conditions exist.
11. Permits and Code Compliance
All work will be performed in accordance with applicable Massachusetts plumbing and building codes.
12. Governing Law
This agreement shall be governed by the laws of the Commonwealth of Massachusetts.
13. Acceptance of Contract
By signing this contract or requesting service verbally, the Client(s) agrees that I/We are the legal Owners of this property or an authorized party that properly represents the interest of the legal Owner(s) of the property and are authorized to engage TruServ Plumbing LLC and are authorized to approve and execute this contract. I/We agree to the above work and to pay TruServ Plumbing LLC in accordance with the described estimate (or Invoice) and pricing and terms of payment. The above prices, specifications and conditions are satisfactory and are hereby accepted. TruServ Plumbing LLC is authorized to do the work as specified.
